Under CCDC 2 in Canada, the contract warranty runs 1 year. It starts at substantial performance. Under AIA A201 in the US, the time to fix work runs 1 year. It starts at substantial completion. Maker and trade warranties start on the date in their letter.
What is the difference between a contractor and manufacturer warranty?
The contractor warranty covers the work for the time set in the contract. The maker's warranty covers the product. It is often longer. It may need the right install and upkeep to stay valid.
What does Tarion cover for new homes in Ontario?
Tarion covers new homes in Ontario for 1 year. Some items get 2 years. Major structural defects get 7 years. Other provinces and states have their own new home rules.
Is a contractor liable for defects after the warranty ends?
Sometimes, yes. Hidden defects can still be claimed under the contract or the law for a time. It depends on your contract and where you work. Ask a lawyer.
How do you keep track of warranty end dates?
Keep one list per job. Note each start date, length and end date. Flag all that end in the next 90 days. Then you have time to walk the building and send defects in writing.
